This privacy policy describes the types of information that The Webstaurant Store, LLC, Clark Core Services, LLC, and its associated companies (collectively “Clark Associates,” “Company,” “we,” or “us”) collect about you and our practices for collecting, maintaining, protecting, using, and disclosing that information.
This policy applies to information that we collect:

If you do not agree with our policies and practices, your choice is to not use our Website. By accessing or using the Website, you accept and agree to be bound and abide by this Privacy Policy and Terms of Use. You should periodically review this privacy policy because it may change from time to time. By continuing to use the Website, you agree to be bound by such changes.
Personal information we may collect about you
The types of personal information relating to you that we may collect depends on your interaction and relationship with us. We may collect the below categories and types of personal information from users and consumers.
- Identifiers: We may collect name, postal address, telephone number, email address, business contact information, signature, online identifiers (Facebook ID, Google ID, LinkedIn ID, Twitter ID, etc.), and complete account access credentials (usernames, account numbers, or card numbers combined with required access/security code or password).
- Financial Information: We use a third party payment processors to collect credit or debit card number, expiration date, CVV number, and any information necessary for processing your payment or online money transfer. If you pay with a credit card or other form of electronic or online payment, the payment information that you provide is transmitted directly to the payment processor who will process and store your personal information. We do not receive this information from the payment processor.
- Audio/Visual Data: We may collect audio, electronic, photographic, visual or similar data including photographs, audio messages, and text messages. In some cases, we may give you the ability to provide a photograph or other likeness or image to us.
- Commercial Information: We may collect records of products or services purchased, obtained, or considered and purchasing histories.
- Internet or Electronic Usage Data: We may collect data related to network and website interaction history, IP address, website cookie information, interaction with advertisements and browsing time, and browsing/search history.
- Geolocation Data: We may collect geolocation data including the general region or area from which you access our Sites and your precise geolocation when you request a delivery.
- Sensitive Information: We may collect complete account credentials.
- Inferences: We may use information from the categories of personal information described above in order to create inferences about you and we may also receive inferences about you from third-parties.
In addition to the above, we may also collect the below categories and types of personal information from job applicants and/or individuals who apply for a scholarship or participate in our scholarship program:
- Identifiers: Social security number, driver’s license number, government issued ID number, state identification card number, passport number, military ID, other government-issued ID, professional certification or license numbers, vehicle information, and tax identification number.
- Characteristics Of Protected Classifications Under State Or Federal Law. We may collect race, ethnicity, national origin, citizenship, physical or mental disability, marital status, gender/gender identity, age/date of birth, union or trade membership status, veteran or military status, and pregnancy and related information, if you choose to provide this information.
- Education Information. We may collect education history and transcripts.
- Professional or Employment Information. We may collect employment history, resume, and references.
- Sensitive Information. We may collect social security, driver’s license, state identification card, passport number, credit or drug test results, racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, union membership, criminal records, and health information.
How we collect personal information
We collect this information:
- Directly from you (for example, from forms you complete, products and services that you purchase, or application forms). The categories of personal information collected may include identifiers, financial information, audio/visual data, commercial information, education information, internet or electronic usage data, geolocation data, characteristics of protected classes/demographics, professional or employment information, and sensitive information.

We may collect information automatically when you visit the Website or when we send you emails, including internet or electronic usage data and geolocation data and other information collected through technologies such as cookies, pixels, web beacons, and other similar technologies.
- From our affiliated or related entities, including but not limited to Noble Chemical, LLC, The Restaurant Store, LLC, Clark Pro, LLC, and Clark National Accounts, LLC.
- From third parties, including partners, vendors and service providers. The categories of personal information collected may include identifiers, financial information, audio/visual data, commercial information, education information, internet or electronic usage data, geolocation data, characteristics of protected classes/demographics, professional or employment information, sensitive information, and inferences.
- From Social Networks. Depending on the information you choose to share and your privacy settings on your social media accounts, we may collect identifiers, audio/visual data, commercial information, education information, internet or electronic usage data, geolocation data, characteristics of protected classes/demographics, professional or employment information, sensitive information, and inferences about you. Based on the way you have set your privacy settings on your social media accounts, most social media platforms, like Facebook, analyze data about how you interact with our Website and combine it with information on other users to provide us information about you. In addition, we may receive information about you if other users interact with us on social media and information about you is visible to us, for example the fact that you are “friends” or other public-facing profile information. We use all of this information to create inferences about you and your preferences.
- From advertising/analytics providers. We may collect identifiers, audio/visual data, commercial information, education information, internet or electronic usage data, geolocation data, characteristics of protected classes/demographics, professional or employment information, sensitive information, and inferences about you from our advertising and data analytics providers. This includes when conduct email campaigns and receive site feedback. It also includes when we receive marketing information, such as trends, usage, and activities from our providers.
How we use your information
We use information that we collect about you or that you provide to us, including any personal information:

- To process your scholarship application.
- To create your account with us, update or correct information in your account, and provide you with notices about your account.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

- To administer your WebstaurantPlus® rewards account.
- For quality assurance and training purposes.
- To enable us to display advertisements to our advertisers’ target audiences.
- To develop co-branded products and services with our third-party business partners and market those products and services to you.

- For any other purpose with your consent.
Call and Video Recording and Monitoring
As part of our commitment to exceptional customer service, we may record and/or monitor your telephone calls, online calls, video calls, virtual meetings and all other types of calls (collectively, “Calls”) with us for quality assurance, training, compliance, legal, and customer service improvement purposes. In addition, if you are a member of our workforce, all Calls that are made and/or received in the course of your work may be recorded and/or monitored for quality assurance, training, compliance, and legal purposes. Our recording and monitoring of workforce calls aims to enhance our services levels and ensure compliance with company policies. To that end, there is no expectation of privacy in any Calls that are made and/or received in the course of your work for us.
Disclosure of your information
We may disclose aggregated information about our users and information that does not identify any individual without restriction. We also may disclose personal information:
- To our subsidiaries, affiliates, and related companies.
- To our contractors, service providers, and other third parties we use to support our business, including payment processors and marketing/advertising companies.

- Publicly for marketing and advertising materials, if you are the winner or recipient of a scholarship or other award offered by Clark Associates. The information we may disclose includes name, photograph, and other biographical (including racial and/or ethnic origin), educational, and/or employment information.
- To fulfill the purpose for which you provide it.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
- To comply with any court order, law, legal obligation, or legal process, including to respond to any government or regulatory request. This includes cooperating with law enforcement when we think it is appropriate, obtaining legal remedies or limiting our damages, enforcing or protecting our legal rights or the rights of others, and responding to claims asserted against us.
- To enforce or apply our Privacy Policy, Terms of Use and other agreements, including for billing and collection purposes.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Clark Associates, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Our Use of Cookies, Pixels, Analytics, and Other Tracking Technologies
Cookies and Tracking Technology. When you access the Website, we (and third-party companies we work with) may collect and store certain information by using technologies such as server logs, cookies, web beacons, clear gifs, tags, e-tags, flash cookies, log files, pixels, code, JavaScript packages, mobile advertising IDs (such as Facebook cookies or Google's Advertising ID), cross-device linking, and similar technologies. The information collected includes information about your activities on our Website, IP address, browser or operating system type and version, device IDs, demographic or inferred-interest information, as well as information or communications you have submitted to us through the Website. Google ReCaptcha. We use Google reCAPTCHA on our Website to ensure the security of our platform and protect against spam and abuse. This service is provided by Google LLC and operates under Google's Privacy Policy and Terms of Service. reCAPTCHA works by collecting hardware and software information, such as device and application data, and sending this data to Google for analysis. This includes the capture of user activity on our website (e.g., mouse movements, clicks, and keystrokes). The data collected is used solely for security purposes and to prevent fraudulent activities. By using our Website, you agree to the use of Google reCAPTCHA and acknowledge that its operation is governed by Google's privacy and terms policies. Our Use of AI and Chatbots
Customer Service and Support. We use chatbots to help provide customer service and support, including through the use of a virtual assistant. A chatbot is a software application that mimics human conversations in text or voice interactions on our website or through our customer service hotline. It enables the communication between a human and a machine, which can take the form of messages or voice commands. The chatbot is designed to work without the assistance of a human operator. It responds to questions posed to it in natural language as if it were a real person using a combination of pre-programmed scripts and machine learning algorithms. When asked a question, the chatbot will answer using the knowledge database that is currently available to it. If the conversation introduces a concept it isn’t programmed to understand; it may pass it to a human operator. If you use our chatbot service, we will collect any personal information you provide to us. Because our chatbots are operated by AI, we make no representations regarding the accuracy of its responses and you should not rely on the accuracy of the responses. We will also create and store a transcript of your chat interaction with us which will then be shared with and stored by our third-party service provider. We use these transcripts and the information you provide for quality control, customer service, marketing, fraud prevention, and security, and to assert or defend legal rights or respond to legal process.
Workforce AI. We also have an internal AI chat that may be used by our workforce. This chat is separate from our customer service chatbot. This chat is also a software application that mimics human conversations in text or voice and also interacts with our workforce. It enables the communication between a workforce member and a machine, which can take the form of messages or voice commands. The chatbot is designed to work without the assistance of a human operator. It responds to questions posed to it in natural language as if it were a real person using a combination of pre-programmed scripts and machine learning algorithms. When asked a question, the chatbot will answer using the knowledge database that is currently available to it. Our employees may use this chat feature, including by entering your personal information in it to assist them in responding to questions or concerns they receive. Because our chatbots are operated by AI, we make no representations regarding the accuracy of its responses. We will also create and store a transcript of your chat interaction with us which will then be shared with and stored by our third-party service provider. We use these transcripts and the information you provide for quality assurance, training, human resources, customer service, fraud prevention, and security, and to assert or defend legal rights or respond to legal process.
Third party links, advertisements and applications
Some content or applications, including advertisements, on the Website are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies (alone or in conjunction with web beacons or other tracking technologies) to collect information about you when you use our Website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. they may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. Webstaurant Rewards Visa®
First National Bank of Omaha (FNBO®), pursuant to a license from Visa U.S.A., Inc., offers customers the opportunity to finance their purchases with a Webstaurant Rewards credit card. If you apply for or are approved for a Webstaurant Rewards credit card, FNBO will collect and process the personal you provide to them in accordance with its privacy policy. We will process any personal information we receive from FNBO in accordance with this Privacy Policy.
Links to Other Websites
Our Website may include links to other websites or applications whose privacy practices may differ from ours. If you submit personal information to any of those websites or applications, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit or application that you use.
Marketing communications
You can opt out of marketing or advertising emails by using the “unsubscribe” link in the email at any time. Once we process your request, we will cease using the information for such purposes at no charge to you. If you opt out of getting marketing messages, you will continue to receive messages from us about your relationship with us where permitted by law, including communications about any warranties or orders. If you do not want to receive marketing phone calls or text messages from us, please inform us that you no longer want to receive calls from us when you receive a call from us, or reply STOP to a text message from us. This opt-out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience, or other transactions.

Please be advised that, if you have an account connected with the Website, we cannot delete your personal information except by also deleting your user account. Only you or someone legally authorized to act on your behalf may make a request related to your personal information. If you are a parent or legal guardian, you may also make a request on behalf of your child. In order to designate an authorized agent to act on your behalf, you must also send a signed, written authorization to us.
For all requests other than requests to opt-out of sale or behavioral/targeted advertising, you must provide us with your name, email address, phone number, the date of your last order, your last order number. We will verify your identity by matching the information we have collected against the information you have provided. Failure to provide that information may prevent us from processing your request. For requests to opt-out of the sale of personal information or behavioral/targeted advertising, we do not need to verify your identity and you only need to provide your name and email address. If you have requested that we correct your personal information, we may also request that you provide information about the personal information that you believe is inaccurate, including supporting documentation.
Appealing our decision
If we refuse to take action on your request, you may appeal our decision within a reasonable period of time, not to exceed 60 calendar days from the date of your receipt of our response. California Notice of Financial Incentive / Colorado Bona Fide Loyalty Program
We offer various financial incentives including a membership program and a rewards program. The terms of the financial incentive and rewards program will be presented to you at the time you sign up. We will ask you to provide personal information, including contact information, in connection with these and other programs. Third parties who will receive personal information collected in connection with our rewards program are described in “Disclosure of your information” section above. It is not our business practice to assign a specific monetary value to personal information. However, the financial incentives we offer to consumers are reasonably related to the value of the consumer’s data to our business. We calculate this in good faith based on our reasonable but sole determination using factors that include expenses we incur to collect, store and keep personal information. We also considered the expenses related to providing the financial incentive.
Participation in any financial incentive program is optional and you may withdraw from participating in financial incentives at any time. You can withdraw or opt-out through your account portal or by emailing us at [email protected]. Opting out may impact your ability to receive additional rewards or promotions. When you cancel, your rewards membership will be deactivated, all offers associated with your membership account will expire immediately, and your account will be deactivated.
Sale, Disclosure, or Sharing of Personal Information and Sensitive Personal Information
We do not sell personal information in exchange for money unless you have opt-ed in to those sales. As described in this policy, we also use cookies, pixels and other technologies on our Website whose collection of information may be a “sale of personal information” or “sharing of personal information for targeted or cross-context behavioral advertising”, as such terms are broadly defined under state privacy laws. In the 12 months preceding the last updated date below, we have “sold” to or “shared” the following categories of personal information: identifiers, contact information, commercial information, geolocation data, internet or electronic usage data, and inferences. We do not knowingly sell or share the personal information of minors under the age of 16.
In the 12 months preceding the last updated date, we have not used or disclosed sensitive personal information for purposes to which the right to limit use and disclosure applies under the CCPA or other similar state privacy laws.
In the 12 months preceding the last updated date above, we have disclosed identifiers, financial information, audio/visual data, commercial information, internet or electronic usage data, geolocation data, and inferences to service providers, analytics/advertising partners, affiliates, and government entities for a business purpose. For employment and scholarship applicants, we have also disclosed characteristics of protected classifications under state or federal law, education information, professional or employment information, and sensitive information to service providers, affiliates, colleges/universities and government entities for a business purpose.
Other California privacy rights
California's “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
